Terms and Conditions

 

 

 

 

1.  Contents of contract and jurisdiction

 

 

The sole subject of the contract with Homebound is the mere hire out of a VW T3 Campervan.
Homebound is under no obligation to provide travel services, and in particular no package of travel services.

The Hirer will organize his journey himself and make use of the vehicle on his own responsibility. The rental contract is limited to the specific period as agreed.
All agreements between Homebound and the Hirer are concluded in writing in form of a Check-In Report upon vehicle collection.

Where there is more than one hirer, each hirer is jointly and severally liable for all obligations of the hirer pursuant to this Agreement.

2. Prices

 

The valid price is the one stated by Homebound at the time the Rental Agreement is made.

Rates are calculated as per night and week and quoted only by Homebound.

 

Additional Costs:

 

The hirer shall: 

1) Pay for all petrol used in the vehicle during the period of hire, operating expenses (i.e. further gas bottles)

 

2) Any penalties relating to parking and/or traffic offences relating to the period of hire, together with an administration fee of 15€ in respect of each infringement

 

3) Any penalties relating to the late collection, or return of the vehicle or any penalties, where the vehicle has been returned to a location, which is not agreed on within the rental agreement

 

4) A security deposit of 500€ is charged upon vehicle collection which serves as a financial security for the owner. The security deposit is returned after the end of the hire and the Check-Out Report has been signed.

Should any damages exceed the security deposit the customer will be responsible to settle all additional costs over and above the security deposit value within 7 days of your hire end date. 

 

 

3. Reservations and Valid Contract

Within 7 days after the issue of a written confirmation, a 20% deposit of the full amount of rental fee is required at the time of reservation. 

Once the 20% deposit is received, the reservation will be confirmed.

Full payment for the rental fee, security deposit and any additional equipment, excess reduction or mileage package is then required upon collection of the vehicle.

 

The rental agreement is valid when:

  1. The full amount of rental fee is paid upon collection of the vehicle

AND

  1. The 500€ security deposit has been received 

AND

  1. The written Check-In Report has been signed

 

If any of these cases are not being fulfilled, the owner has the right to deny the let of vehicle.

Each rental amendment will be charged according to the
valid price list. After conclusion of the rental agreement the customer is not entitled to any changes with regard to begin of term of rental.

 

 

4. Driver

The Hirer and any other driver must be at least 25 years old and must be in possession of a Class III/Class B or comparable nationally valid driving license for at least two years, correspondingly appropriate to the weight of the vehicle.

 

 

5. Cancelation

If the confirmed campervan booking is cancelled within 4 Days after the booking has been made, we will refund your 20% deposit in full.

(This does not apply with pick-ups within 14 days of booking, in which case the 20% deposit is not being refunded.)


If the confirmed campervan booking is cancelled 6 weeks before rental date the 20% deposit is not refunded.

Between 4 to 2 weeks before beginning of rental 50 % of full rental price are charged.

 

Less than 2 weeks before beginning of rental 80 % of rental price are charged.

If the Confirmed booking is cancelled within 2 days before pick up, or there is a no show, we will charge full amount of rental fee balance for the rental.

If the vehicle is returned before the expiry of the agreed rental period, the full contractually agreed hire charge must be paid unless the vehicle can be hired out to someone else.

 

 

6. Duration of hire and booking amendments 

The term of hire shall be for the calendar days stated in the Rental Agreement. 

 

Vehicle collections or drop offs outside the times and periods or locations detailed in the rental agreement will incur a fee.

 

All extensions need to be compromised with the owner.

For any uncompromised extensions there will be a charge of 25€ for every started hour. 

Is the extension endangering a follow-up rental, there will be an additional fee of 50€.

It is possible to extend your rental without incurring a fee subject to availability.
It is possible to shorten your rental within 21 Days of pick up. Shortening a rental will be quoted as a new rental and will be subject to availability and calculated at the retail rate with any current specials not applicable. 

 


7. Hirers Obligations

The vehicle must be treated carefully and appropriately and properly locked on all occasions.
The regulations and technical rules applicable to its use must be complied with.

It’s running condition, in particular oil and water levels and tire pressure, must be monitored and maintained on appropriate level.
The Hirer undertakes to check regularly to make sure that the vehicle is in a roadworthy condition. 

 

The Hirer will be liable for all damage, costs and expenses associated with any careless or negligent use of the vehicle, including but not limited to damage arising from failure to ensure appropriate levels of petrol, oil or water are maintained.

The Hirer is prohibited from using the vehicle as follows: to participate in motor sport events and vehicle tests, to transport easily inflammable, poisonous or otherwise dangerous substances, to commit Customs or other criminal offences, even if these are only punishable
according to the law applicable in the place where the offence was committed, for rental to a third party or for the commercial transport of passengers or for any other use going beyond that agreed by contract, in particular driving on terrain not intended for the purpose.

No driving on unpaved roads (excluding county and state maintained roads), dirt roads, restricted areas and 'off road' areas. In case of negligence the Hirer is liable for all damages to vehicle, tires, towing charges and other expenses as a result of a breakdown, collision, or any other incident.

The Hirer is prohibited to use the vehicle outside the territory of the Canary Islands. 

Every ferry crossing to another Canary Island is to be compromised with the owner beforehand and an additional insurance cover is required.

 

If evidence of violation of the provisions in the aforementioned paragraphs can be provided, the Owner may terminate the lease immediately without notice. There will be no compensation.

 

 

8. Collections and Check-In 

Before driving the wheel, the Hirer is under an obligation to take part in a detailed introduction to the vehicle by the Homebound experts at the collection spot. 

On that occasion, there is drawn up a detailed written report (Check-In) of delivery describing the condition of
the vehicle that is to be signed by both parties. Homebound is entitled to refuse to hand over the vehicle until this introduction has taken place. 

If handover is delayed due to the fault of the Hirer, he must bear any costs incurred as a result. With signing the detailed report the Hirer also acknowledges the Terms and Conditions.

 

On returning the vehicle, the Hirer is under an obligation to carry out a final examination of it together with Homebound staff, with a written return report (Check-Out) to be prepared and signed by Homebound and the Hirer. 

Any damage not specified in the report of delivery that is detected upon return of the vehicle shall be at the renter‘s expense.

The vehicles are delivered with a clean interior and are to be returned by the renter in the same condition as are received. 

Should the interior not be in the same clean condition as received, the renter will be liable for the cleaning fees, which will be deducted an extra cleaning fee of 50€ from the security deposit plus:

 

Fridge 15€

Upholstery 20€

Pets (Hair and Dirt) 30€

All vehicles are non-smoking vehicles. 

This means that you may not smoke in any part of
the vehicle. 

Pets may only be brought along subject to the lessor‘s explicit approval. 

Cleaning expenses caused by non-compliance with regulations must be borne by the Hirer.
Any costs, which may be incurred by deventilation or for elimination of contamination with smoke, including lost profits resulting from temporary non-availability of the vehicle for hire owing to these circumstances, shall also be borne by the Hirer.

 

The Campervan will be supplied with a full tank and must be returned in the same condition.
Otherwise, Homebound will charge the fuel according to the valid price list plus an additional fee of 15€.

It is forbidden to fix any stickers to the vehicle.

 

 

9. Accessories and Extras

Any accessories ordered like cutlery, crockery, bikes etc. must be returned in proper condition and full amount.

Replacement costs are charged to the Hirer and deducted from the safety deposit.

 

 

10. Damages and Accidents 

In general, any damages or defects noticed by the Owner before the collection are treated as followed:

  1. The Hirer takes the vehicle the next day after repair (1 day compensation)

  2. The Hirer takes the vehicle albeit the defects and agrees to be free of charge

If Homebound is unable to provide a fully functioning vehicle as booked, Homebound has to offer another comparable vehicle. Is the compensation with another vehicle not possible (out of any reason i.e. vehicle down time), the Hirer has the right to null the rental agreement. In this case, the Hirer receives the full payment back, but Homebound is not liable to indemnify.

 

Mechanical Damages: 

In case of any mechanical damage, the owner is to be contacted immediately in order to decide how to proceed. 

Repairs done without the Owner’s knowledge are charged to the Hirer alone. 

Repairs done in agreement with the owner are refunded only with an original valid receipt from a proper garage.

Costs for room rentals, the rental of a replacement vehicle etc. are responsibility of the Hirer’s additional private travel insurance. i.e. a recommended ADAC Plus Membership.

In case there is no additional private travel insurance existent, the Hirer has to cover all emerging costs himself.

Wear and Tear Damages:

Any wear and tear damages are at the owner’s expense, unless they are result of inadequate and inappropriate usage.

Any damages occurring en route are to be commented to the owner immediately via phone or in written form.

Is professional repair necessary, the Hirer requires the Owners’ permission to take it to the nearest competent garage.

The Hirer is not permitted to choose and decide for a garage on his own. In accordance with the Owner, a garage is chosen and any repair details need to be compromised with the Owner directly.

 

Rock Fall Damages (Windscreen and Windows): Due to insurance claims, any rock fall damages are not repaired but the entire affected window is changed. Costs (up to 300€) are charged to the Hirer.

Tire Damages: Any damages occurring en route go in account of the Hirer, same as material costs and installation costs. 

Water and Fuel system: Wrongly filled water tank or fuel tank cannot be cleaned and emptied. They need to be changed completely in order to guarantee and ensure further roadworthiness. Costs are charged to the Hirer, as well as any resulting damages. 

Theft: In case of theft the owner is to be informed immediately. The safety deposit is kept. Since vehicles cannot be insured against theft, a responsible choice of appropriate parking is of highest priority.

 

 

11. Accidents

After an accident, theft or damage by fire or collision with a wild animal, the police and Homebound must be informed immediately. 

It is not permitted to accept any third-party claims as valid.

 

Even in the case of very slight damage, the Hirer must prepare a detailed written report for Homebound, including a sketch. 

If, for whatever reason, the Hirer fails to draw up such report and if, because of that, the insurance company refuses to pay the damage, the Hirer shall be obliged to pay full compensation for the damage.
The accident report must in particular include the names and addresses of anyone involved and any witnesses, together with the license numbers of all vehicles involved and has to be over handed filled out and signed by drop off latest towards Homebound.

 

In case the vehicle is not roadworthy, the owner is to be informed immediately.

 

Any costs for phone calls, cancellation expenses etc. that are not issue of the insurance cover (stated and signed in the contract) are not refunded by the Owner.

 

 

 

12. Insurance Cover

There is no insurance cover for theft or loss of personal goods and equipment.

The loss of car documents, tools, accessories and personal goods are exclusively of the Hirers responsibility and are not compensated by the Owner.

The Hirer is in obligation to inform himself about the road and travel specifications and standards in the chosen country of vacation!

 

 

13. Privacy Act

The Hirer acknowledges that the owner will collect, hold and use the hirer’s personal information for purposes related to the hire of the vehicle and the provision of related customer services, including direct marketing and assessing customer satisfaction with products and services of the Owner. The Hirer further acknowledges that such personal information may be disclosed to debt collection agencies in the event that the hirer defaults in the payment of any monies owing to the owner and the hirer hereby authorises the disclosure of its personal information for such purpose.
